U.S. District Court Throws Out Delaware Riverkeeper Lawsuit Against Soil Recycling Company Soil Safe
Judge Rejects All Riverkeeper Allegations Against Soil Safe
CAMDEN, NJ – July 14, 2017 – U.S. District Court Judge Renee Marie Bumb has rejected a three-year-old complaint filed by the Delaware Riverkeeper Network, affirming that Soil Safe’s recycling product is safe and its process is “…`textbook’ recycling of materials."
Soil Safe operates a soil recycling facility in Logan Township, where it recycles low-level, petroleum-contaminated soil as permitted by the New Jersey Department of Environmental Protection. The recycled and engineered soil product is then used to remediate three locations, known as the Birch Creek Property, the Logan Equine Park and Gloucester County Park.
In her June 30 ruling, Judge Bumb found that Soil Safe acted properly and rejected the Riverkeeper’s request for injunctive relief and compensation. In court, the company demonstrated it follows all regulations established for its “Class B” recycling permit, the Remedial Action Workplans for the three locations, and the 16 other permits the DEP and Gloucester County issued and regularly review.
